PYRO-CHEM WARRANTY
With regard to any Flag Fire manufactured equipment sold hereunder, Flag Fire warrants all such manufactured equipment against defects in material and workmanship for a period of six full years (6 years) from date of shipment to the Purchaser. Flag Fire is not responsible for the installation or the maintenance of the equipment. In no event shall Flag Fire be responsible for any personal injury, property damage or other losses resulting from the failure of such Products to operate properly, since Flag Fire’s sole responsibility for defective or nonconforming Products. Accordingly, the exclusive remedy for breach of this Warranty is the repaid or replacement of defective or nonconforming Products Flag Fire itself (or by others pursuant only to Flag Fire’s prior written authorization) or the return of that portion of the purchase price represented by such defective or nonconforming Products, and in no case shall Flag Fire’s liability under any other remedy prescribed by law exceed the value of that portion of the purchase price represented by such defective or nonconforming Products. Purchaser (and its customers purchasing or otherwise utilizing products sold hereunder) acknowledges by its or their acceptance of any of Flag Fire’s products covered by this warranty that there are no express or implied warranties as to quality or merchantability or the fitness for any particular purpose of said products in connection with their purchase or use other than as provided in this paragraph. This warranty is void in case of Product abuse, misuse, abnormal or improper usage or storage, faulty installation or repair by unauthorized persons, or contamination of chemical agent by air, water, other chemicals or by other means. In any event, Flag Fire shall have no liability for incidental contingent or consequential damages of any kind, including lost profits, resulting from defects in any of Flag Fire’s products or otherwise. Product replacements will be made at Flag Fire’s facility at Marinette, WI (800) 265-0804 or (715) 732-3465 such other locations as shall be specified by Flag Fire, and transportation costs to such location shall be paid by the Purchaser or its customers. Replacement shipment will be paid by Flag Fire. Any disputes regarding matters of Warranty and administrations will be resolved at the sole discretion of Flag Fire.
